Welcome to VoiceKeeper
These Terms of Service ("Terms") are a legal agreement between you and VoiceKeeper. By using our service, you agree to these Terms. Please read them carefully.
The simple version: Use VoiceKeeper to preserve your memories and voice for your family. Be respectful. Don't abuse the service. Pay your bill. We'll do our best to keep your memories safe forever, but technology isn't perfect. If something goes wrong, we'll fix it, but we can't be held responsible for everything.

Accepting These Terms
By creating an account, uploading recordings, or using VoiceKeeper in any way, you agree to:
- These Terms of Service
- Our Privacy Policy
- Any additional terms for specific features
If you're using VoiceKeeper on behalf of someone else (like a parent or grandparent), you represent that you have authority to agree to these Terms on their behalf.
Changes to Terms
We may modify these Terms from time to time. When we do:
Minor changes:
- Posted immediately on this page
- Effective immediately
- Notice via email (optional)
Major changes (affecting your rights or money):
- 30 days advance notice via email
- Prominent in-app notification
- Right to cancel and get a pro-rated refund if you disagree
Your continued use after changes means you accept the new Terms. We'll never make retroactive changes that remove rights you already have.
Your Account
Creating an Account
To use VoiceKeeper, you need to:
- Provide accurate information (name, email, etc.)
- Create a secure password
- Verify your email address
- Be at least 18 years old (or have parental consent)
Account Security
You are responsible for:
- Keeping your password secure (don't share it)
- All activity on your account
- Notifying us immediately if you suspect unauthorized access
We recommend: Using a strong, unique password, enabling two-factor authentication, and not logging in on public/shared computers.
Account Ownership
Your account belongs to you. We don't own your memories or recordings. But:
- If you don't pay your bill, we can suspend or delete your account
- If you violate these Terms, we can terminate your account
- If you're inactive for 2+ years, we may contact you about closing your account
Age Requirements
Primary Users
You must be 18 or older to create an account.
If You're Under 18
- A parent or legal guardian must create the account in their name
- They are responsible for all Terms and payments
- You can use the account with their permission
- The account legally belongs to the parent/guardian
Recording Minors
You can record memories that include children's voices if you are the parent or legal guardian, OR you have explicit permission from their parent/legal guardian.
How You Can Use VoiceKeeper
You can use VoiceKeeper to:
- ✓Record your own life stories and memories
- ✓Preserve your voice for future generations
- ✓Share access with family members you designate
- ✓Create AI conversations based on your recordings
- ✓Download and export your data at any time
- ✓Use recordings for personal, non-commercial purposes
How You Cannot Use VoiceKeeper
You agree NOT to:
✗ Impersonate someone else
- Don't create an account pretending to be another person
- Don't record someone else's voice without permission
- Don't claim someone else's memories as your own
✗ Upload illegal or harmful content
- No child sexual abuse material (CSAM) - immediate termination and reporting to authorities
- No content that promotes violence, terrorism, or hate
- No instructions for illegal activities
- No harassment, threats, or bullying
✗ Abuse the service
- No spam or mass automated recordings
- No attempting to hack, breach, or circumvent security
- No reverse engineering the AI or voice cloning technology
- No creating fake or AI-generated "memories" of events that didn't happen
✗ Violate intellectual property
- Don't upload copyrighted content you don't own (songs, movies, etc.)
- Reading a book aloud is fine; uploading an audiobook isn't
- Quoting others is fine; pretending you wrote something is not
✗ Commercial use without permission
- Don't use VoiceKeeper to create content for sale
- Don't use the AI for business purposes
- Don't create celebrity impersonations or deepfakes
Violation of these terms may result in immediate account termination without refund.
Your Content
What You Own
You own all rights to:
- Your original recordings
- Your memories and stories
- Photos and videos you upload
- The transcripts of your recordings
We do not claim ownership of your content.
License You Give Us
By using VoiceKeeper, you grant us a license to:
- Store and process your recordings (we can't provide the service otherwise)
- Create transcripts using AI transcription services
- Analyze your content to build your personality profile
- Generate AI responses based on your memories
- Create and use your voice clone to generate speech
- Share with family members you explicitly authorize
This license is: Non-exclusive (you can use your content however you want), limited to providing VoiceKeeper services, and revocable (ends when you delete your content or account).
What We Can't Do With Your Content
We will NEVER:
- Sell or license your content to third parties
- Use your content to train general AI models
- Share your content publicly without your permission
- Use your voice clone for any purpose other than your AI
- Allow anyone except authorized family members to access your content
AI-Generated Content
How the AI Works
VoiceKeeper uses AI to:
- Transcribe your audio recordings (OpenAI Whisper)
- Analyze your personality and speaking style (Anthropic Claude)
- Generate conversational responses (Anthropic Claude)
- Create synthetic speech in your voice (ElevenLabs)
Accuracy and Limitations
The AI is not perfect. You understand and agree that:
- ✗The AI is not actually you. It's a tool that approximates your personality based on recorded memories.
- ✗Responses may be inaccurate. The AI might misinterpret context, combine memories incorrectly, or make mistakes.
- ✗The AI only knows what was recorded. It can't recall memories you never shared.
- ✗Voice clones aren't perfect. Your cloned voice may sound slightly different than your real voice.
- ✗The AI can't predict the future or give professional advice (medical, legal, financial).
Family members should understand they're talking to an AI representation, not the actual person.
Voice Cloning and Biometric Consent
Explicit Consent Required
By using VoiceKeeper's voice cloning features, you explicitly consent to:
- Collection of your biometric voice data
- Analysis of your voice characteristics
- Creation of a synthetic voice model ("voice clone")
- Use of your voice clone to generate AI responses
- Storage of your voice clone for the duration of your account
Biometric Information Notice
Your voice recordings contain biometric identifiers (unique characteristics of your voice). This data is:
- Collected with your explicit consent
- Stored securely with encryption
- Used only for creating your AI voice
- Shared only with authorized AI service providers (ElevenLabs)
- Never sold or used for other purposes
- Deletable at any time by you
Illinois residents: This notice satisfies requirements under the Biometric Information Privacy Act (BIPA).
Withdrawing Consent
You can withdraw consent and delete your voice clone at any time: Settings → Voice Clone → Delete Voice Clone. This does NOT delete your recordings (only the AI voice model). You can recreate a new voice clone later.
Family Member Access
Inviting Family Members
You can invite family members to access your AI after you pass away. You agree that:
- You have authority to share your memories with them
- They will only gain access after your death (verified)
- They will abide by these Terms when using the service
- They cannot transfer their access to others
Designating Access
You control:
- Who gets access (specific email addresses)
- What they can access (all memories vs. specific categories)
- When access is granted (immediately upon your passing)
After Your Death
When your account status changes to "deceased":
- Family members receive notification
- They can create accounts to access your AI
- They can view memories you shared
- They can have conversations with your AI
- They cannot edit or delete your content (unless designated as executor)
Revoking Access
While alive, you can: Remove family members from your access list anytime, change access levels (full, limited, none), and designate an "executor" who can manage your account after death.
Payment and Billing
Pricing
Current pricing is available at voicekeeper.app/pricing. Prices include:
Lifetime Access:
- One-time payment
- No recurring fees
- All features included
- All future updates included
Payment Methods
We accept: Credit cards (Visa, Mastercard, Amex, Discover), debit cards, and Apple Pay / Google Pay.
All payments processed securely through Stripe.
Taxes
You are responsible for sales tax (if applicable in your state/country), VAT (if applicable), and any other applicable taxes. Taxes are calculated at checkout based on your billing address.
Failed Payments
If your payment fails:
- We'll email you immediately
- We'll retry payment 3 times over 10 days
- After 10 days, your account may be suspended
- After 30 days, your account may be terminated
We'll never delete your recordings due to failed payment without notice.
Refund Policy
30-Day Money-Back Guarantee
If you're not satisfied, we offer a full refund within 30 days of purchase if:
- You haven't used the service extensively (less than 5 hours of recordings)
- You request a refund in writing (email to support@voicekeeper.app)
- You delete your account
No questions asked. We'll process your refund within 5-7 business days.
After 30 Days
Refunds after 30 days are at our discretion and may be granted if:
- There's a technical problem we can't fix
- The service doesn't work as described
- There are extenuating circumstances
What's Not Refundable
- Lifetime access after 30 days of active use
- Partial refunds for unused time
- Refunds due to your violation of Terms
- Refunds if your account was terminated for cause
How to Request a Refund

Include: Your account email, reason for refund, and confirmation you want to delete your account.
Service Availability
Our Commitment
We strive to provide:
- 99.9% uptime (excluding scheduled maintenance)
- Fast response times
- Regular backups of your data
- Security updates and improvements
No Guarantee of Perfect Service
However, you understand that:
- ✗Technology fails sometimes. Servers crash, internet goes down, bugs happen.
- ✗We'll have maintenance windows. We'll notify you in advance (usually).
- ✗Third-party services can fail. We rely on AWS, OpenAI, Anthropic, and ElevenLabs. If they go down, we go down.
What We'll Do If There's an Outage
- Fix it as fast as possible
- Notify you about the issue
- Keep you updated on progress
- Conduct a post-mortem (for major outages)
Our Responsibilities (and Limitations)
What We Promise
- ✓We'll store your recordings securely
- ✓We'll protect your data with industry-standard encryption
- ✓We'll process your content as described in our Privacy Policy
- ✓We'll provide the service with reasonable care and skill
- ✓We'll notify you of major changes or issues
What We Don't Promise
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We specifically disclaim:
- Warranties of merchantability - No promise it's perfect for your needs
- Warranties of fitness - No promise it'll do exactly what you want
- Warranties of non-infringement - No promise no one will object to your content
- Warranties of accuracy - AI transcription and responses may contain errors
- Warranties of reliability - Service may have bugs or downtime
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We are NOT liable for:
- Indirect damages - Lost profits, lost opportunities, emotional distress
- Consequential damages - Problems that arise from service issues
- Incidental damages - Additional costs you incur
- Data loss - If something goes wrong with backups
- AI errors - Inaccurate transcriptions, inappropriate responses, voice clone issues
- Third-party actions - Family members misusing access, hackers, etc.
MAXIMUM LIABILITY: Amount you paid us in the last 12 months (or $100, whichever is greater).
Intellectual Property
Our Intellectual Property
VoiceKeeper owns:
- The VoiceKeeper name, logo, and branding
- The VoiceKeeper website and apps (code, design, features)
- Our AI training methods and algorithms
- All content we create (help docs, marketing materials)
You may not: Copy our code or reverse engineer our service, use our trademarks without permission, or claim our work as your own.
Your Intellectual Property
You own: Your recordings and memories, your voice and likeness, and any content you create.
We own: The AI personality profile we create (derived from your content), the voice clone we create (derived from your voice), and the transcripts and analysis (derived works).
Both you and we have rights in the AI outputs. This is a shared creation.
Termination
You Can Leave Anytime
To delete your account:
- Go to Settings → Account → Delete Account
- Confirm you want to delete everything
- We'll send a confirmation email
- After 30 days, everything is permanently deleted
Before 30 days: You can recover your account.
After 30 days: Everything is gone forever.
We Can Terminate You
We may suspend or terminate your account if:
- You violate these Terms
- You upload illegal content
- You don't pay your bill
- You abuse the service or harass others
- We're required by law to terminate you
Notice: Usually 30 days notice (for minor violations), immediate termination (for serious violations like illegal content). You can appeal termination decisions.
What Happens After Termination
- Your access ends immediately
- Your recordings are kept for 30 days (recovery period)
- After 30 days, everything is deleted permanently
- Family member access is revoked
- Outstanding bills are still due
Disputes and Legal Stuff
Governing Law
These Terms are governed by the laws of California, United States, without regard to conflict of law principles.
Dispute Resolution
Step 1: Talk to Us
If you have a problem, email us at support@voicekeeper.app. We'll try to resolve it within 30 days.
Step 2: Mediation
If we can't resolve it, we'll try mediation (neutral third party helps us reach agreement). Mediation is voluntary but encouraged.
Step 3: Arbitration (Not Court)
If mediation fails, we agree to binding arbitration instead of court: Individual arbitration only (no class actions), American Arbitration Association (AAA) rules apply, location is your state or virtual, and we pay filing fees up to $10,000.
Class Action Waiver
YOU AGREE TO ARBITRATE DISPUTES INDIVIDUALLY, NOT AS PART OF A CLASS ACTION. You can opt out of arbitration by emailing us within 30 days of creating your account.
Small Claims Court Exception
You can bring a claim in small claims court (if eligible) instead of arbitration.
General Terms
Entire Agreement
These Terms, plus our Privacy Policy, constitute the entire agreement between you and VoiceKeeper. They supersede any prior agreements or understandings.
Severability
If any part of these Terms is found invalid or unenforceable, the rest still applies.
No Waiver
If we don't enforce a right immediately, that doesn't mean we've waived it. We can still enforce it later.
Assignment
You cannot transfer your account or these Terms to anyone else without our permission. We can transfer our rights and obligations (for example, if we're acquired by another company).
Force Majeure
We're not liable for delays or failures caused by events beyond our control: Natural disasters, war, terrorism, government actions, internet or power outages, pandemics.
Survival
These sections survive account termination: Your Content (ownership), Intellectual Property, Limitation of Liability, Disputes and Legal Stuff.
